1. Age Requirement
You must be 18 years of age or older — or the legal drinking age in your country, whichever is higher — to use Cellar Social. By using this app you confirm that you meet this requirement. This app contains alcohol-related content and is intended for adults only. We reserve the right to terminate access for any user we believe does not meet this age requirement.
2. The Service
Cellar Social is a private iOS app for wine enthusiasts. It provides AI-powered wine label scanning, personal wine collection management, wine farm visit logging, private social circles, nearby event discovery, a private forum within each circle, gift tracking, and messaging between circle members.
3. Subscription and Billing
Cellar Social requires an active subscription to access all features. A 7-day free trial is available for new subscribers on both plans.
- Monthly plan: $2.99 USD per month
- Annual plan: $29.99 USD per year (saving approximately 16%)
Payment is charged to your Apple ID at the end of the free trial period. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. To manage or cancel your subscription go to: iPhone Settings → tap your name → Subscriptions → Cellar Social.
4. AI-Generated Content — Important Disclaimer
Wine identifications, producer information, tasting notes, vintage details, drinking window estimates, and any other wine information displayed in Cellar Social are generated by artificial intelligence (Google Gemini). This content may not always be accurate for every wine label and should be treated as a starting point, not a definitive source.
Specifically:
- Wine identification may be incorrect for obscure, private label, or poorly photographed labels
- Retailer prices and availability returned by the Find Online feature are not guaranteed to be current or accurate
- Drinking window suggestions are estimates only and may not reflect the actual condition of a specific bottle
- Tasting notes are AI-generated and may not match your own experience of a wine
Protea Studios (Pty) Ltd accepts no liability for any purchasing decisions, financial loss, or other outcome arising from reliance on AI-generated wine information in this app.
5. User Content
You retain ownership of content you create in the app, including wine reviews, tasting notes, farm visit logs, forum posts, gift messages, and circle contributions. By posting content within a circle, you grant other members of that circle the right to view it for as long as you remain a member of that circle.
You are responsible for ensuring that your content:
- Does not infringe the intellectual property rights of any third party
- Does not contain defamatory, abusive, or unlawful material
- Does not promote irresponsible alcohol consumption
- Does not contain spam, advertising, or commercial solicitation
We reserve the right to remove content that violates these requirements.
6. Private Circles
Circles are invitation-only groups. All content posted within a circle is visible to every current member of that circle. You are solely responsible for who you invite to your circles. Protea Studios (Pty) Ltd is not responsible for content posted by other circle members.
Circle membership and content may be visible to new members you invite after the content was originally posted. Consider this before sharing sensitive information within a circle.
7. Account and Data Deletion
You can delete your account and all associated data at any time by going to Settings → Delete Account within the app. This action is permanent and cannot be undone. All your wines, circle memberships, reviews, visits, messages, and other content will be permanently deleted from our database.
8. Privacy
Your use of Cellar Social is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the app you also agree to our Privacy Policy.
9. Acceptable Use
You may use Cellar Social for personal, non-commercial purposes only. You may not:
- Use the app to harass, abuse, or harm other users
- Post content that is illegal, defamatory, or infringes third-party rights
- Attempt to reverse engineer or copy any part of the app
- Use automated tools to scrape, scan, or interact with the app
- Attempt to circumvent subscription requirements
- Use the app for any commercial purpose without written permission from Protea Studios (Pty) Ltd
Violations of these terms may result in immediate termination of your access to the app.
10. Intellectual Property
The Cellar Social app, its name, design, branding, and all original content are owned by Protea Studios (Pty) Ltd. AI-generated wine information is generated fresh for each query and is not proprietary content owned by Protea Studios (Pty) Ltd or by the user.
11. Availability and Changes
We aim to keep Cellar Social available at all times but do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. We will give reasonable notice of any material changes where possible. Continued use of the app after changes constitutes acceptance of the updated Terms.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Protea Studios (Pty) Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from:
- Your use of or inability to use Cellar Social
- Reliance on AI-generated wine information
- Content posted by other circle members
- Any interruption or discontinuation of the service
- Any purchasing decisions made based on information in the app
13. Indemnification
You agree to indemnify and hold harmless Protea Studios (Pty) Ltd from any claims, damages, or expenses arising from your violation of these Terms, your user content, or your misuse of the app.
14. Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date above when we do. For material changes, we will make reasonable efforts to notify users. Continued use of the app after changes are posted constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of Cellar Social shall be subject to the exclusive jurisdiction of the South African courts.
